Terms of Service

1. Acceptance of Terms

By accessing or using WattTrim ("the Service"), operated by WattTrim ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

WattTrim provides an electricity savings analysis tool for Texas homeowners. The Service analyzes your electricity usage data to compare available electricity plans and estimate potential savings. The Service is available as:

• One-Time Audit — a single analysis of your uploaded usage data ($14.99)
• Monthly Monitoring (Sentinel) — an optional recurring subscription for ongoing rate monitoring ($4.99/month), which includes free audits, contract expiry reminders, and early savings alerts for the duration of the subscription
• Solar Feasibility Study — a one-time solar savings analysis ($17.99, free for Sentinel subscribers)
• Quick Estimate — a free, instant estimate of potential savings based on basic usage information

3. Informational Purposes Only

The audit results, plan recommendations, and estimated savings provided by the Service are for informational purposes only and are based on historical usage data and publicly available rate information. We do not guarantee the accuracy, completeness, or timeliness of any information provided. Final energy rates, fees, and terms are determined solely by the Retail Electric Provider (REP). WattTrim is not a Retail Electric Provider and does not sell electricity.

4. User Data and Privacy

Your electricity usage CSV file is parsed entirely within your web browser and is never uploaded to our servers. Only aggregated monthly summary data (total kWh usage per month) is transmitted to our API for analysis. We do not store your raw usage files. For full details, see our Privacy Policy.

5. Payments and Refunds

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service.

• One-Time Audit: Subject to the Savings Guarantee described in Section 6 below.
• Monthly Monitoring (Sentinel): You may cancel your subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing cycle. No partial refunds are issued for unused portions of a billing period.
• Solar Feasibility Study: Non-refundable once results are delivered, as the digital service is fully rendered at the time of purchase.
• Bundle Purchases: When purchasing the Audit + Sentinel bundle, the one-time audit fee is waived and only the monthly monitoring subscription rate applies. The Savings Guarantee does not apply to bundle purchases, as no separate audit fee is charged.

6. Savings Guarantee

WattTrim offers a Savings Guarantee on standalone one-time audit purchases:

• Eligibility: The guarantee applies only to the one-time audit fee ($14.99) paid by a customer who is not an active Sentinel monitoring subscriber and did not purchase via the Audit + Sentinel bundle.
• Trigger: If the audit analysis determines that your estimated annual savings from switching plans is $50.00 or less, the guarantee is automatically activated.
• Refund: When the guarantee is triggered, your $14.99 audit fee is automatically refunded to your original payment method. No action is required on your part.
• Exclusions: The Savings Guarantee does not apply to: monthly monitoring subscriptions, bundle purchases, purchases made with promotional or referral codes, Solar Feasibility Study purchases, or situations where inaccurate or incomplete data is provided by the customer.
• One-Time Use: The guarantee applies once per transaction. Re-running an audit as a monitoring subscriber does not qualify for a guarantee refund.

The Savings Guarantee is offered at WattTrim's sole discretion and may be modified or discontinued at any time with notice posted on this page.

7. Prohibited Use

You agree not to:

• Scrape, crawl, or systematically extract data from the Service
• Reverse-engineer, decompile, or attempt to derive the source code or algorithms of the Service
• Use the Service for any unlawful purpose
• Resell, redistribute, or commercially exploit the audit results without written permission
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any portion of the Service

8. Intellectual Property

All content, design, logos, trademarks, and software associated with WattTrim are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, WattTrim and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or savings, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
